These Terms and Conditions ("Terms") govern your access to and use of our website www.atlaswhite.com (the "Site"), our home renovation services, and any related content, products, or materials provided by us (collectively, the "Services"). By accessing the Site, submitting an inquiry, or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

These Terms form a legally binding agreement between you ("you" or "user") and Atlas White, a home renovation company serving Edmonton, Alberta, and surrounding areas. Our motto—Fix. Renovate. Transform—guides our commitment to quality and customer satisfaction.

We may update these Terms at any time. Significant changes will be posted on the Site with an updated effective date. Continued use after changes constitutes acceptance. Please review periodically.

1. Use of the Site and Services
Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using the Site or Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
Permitted Use
You may use the Site for personal, non-commercial purposes to learn about our renovation services, request quotes, or contact us. You agree not to:

Copy, reproduce, or distribute content without permission.

User Content
If you submit content (e.g., project details via forms, reviews), you grant us a non-exclusive, royalty-free license to use it for promotional or service-related purposes. You represent that your content does not infringe third-party rights and is not defamatory.

2. Description of Services
Atlas White provides home renovation services, including fixes, renovations, and transformations for kitchens, bathrooms, basements, and more. Services are customized based on consultations and quotes. All work complies with Alberta building codes and standards.
We reserve the right to refuse or cancel services at our discretion, including for safety reasons or non-payment.

3. Quotes, Orders, and Payments
Quotes
Quotes are estimates and subject to change based on site inspections, material costs, or unforeseen issues. Quotes are valid for, 14 days unless stated otherwise.
Orders and Contracts
Service agreements are separate from these Terms and may include detailed scopes, timelines, and pricing. By signing a contract, you agree to its terms.
Payments
Payments are due as specified in the contract (e.g., deposits, progress payments, final balance). We accept cash, credit cards, e-transfers and certified cheques. Late payments may incur fees or interest at, 1.5% per month. All prices are in Canadian dollars (CAD) and exclude taxes (GST applies).
Refunds and Cancellations
Refunds are at our discretion. Deposits are non-refundable except as required by Alberta consumer protection laws. Cancellations within, 48 hours of booking may incur fees.

4. Intellectual Property
The Site and Services content (text, images, logos) are owned by Atlas White or our licensors and protected by Canadian copyright and trademark laws. You may not use our trademarks without permission. Limited personal use is allowed; commercial use requires written consent.

5. Disclaimers and Limitations of Liability
Disclaimers
The Site and Services are provided "as is" without warranties, express or implied, including merchantability or fitness for a particular purpose. Quotes and advice are for general guidance; we are not liable for errors or omissions.
Limitation of Liability
To the fullest extent permitted by law, Atlas White, its affiliates, and employees shall not be liable for indirect, incidental, consequential, or punitive damages arising from the Site or Services, even if advised of the possibility. Direct liability is limited to the amount paid by you in the past 12 months.
For renovation services, liability is limited to the contract value, excluding delays due to weather, suppliers, or your actions.

6. Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the Site/Services, breach of these Terms, or violation of third-party rights.

7. Governing Law and Dispute Resolution
These Terms are governed by the laws of Alberta and Canada, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Edmonton, Alberta.
We encourage informal resolution first. For unresolved issues, you may contact Alberta's Consumer Investigations Unit.

8. Force Majeure
We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, strikes, pandemics).

9. Termination
We may suspend or terminate your access for violation of these Terms. Upon termination, obligations like payment survive.

10. Miscellaneous
These Terms constitute the entire agreement. If any provision is invalid, the remainder remains enforceable. No waiver of rights unless in writing. You may not assign these Terms; we may.
